LIMITED PRODUCT WARRANTY
Period: 1 year
This Limited Product Warranty (“Warranty”) gives you, (“End User”), an express limited warranty rights from A.K.O. Inc., including its parent(s), subsidiary(s), or affiliate(s) (“AKO”), the manufacturer.
AKO MAKES NO OTHER EXPRESS WARRANTY OR CONDITION WHETHER WRITTEN OR ORAL AND AKO EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS NOT STATED IN THIS LIMITED PRODUCT WARRANTY. AKO DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR ANY WARRANTY IMPLIED THROUGH COURSE OF CUSTOM OR USAGE OF TRADE.
AKO warrants that the AKO equipment or product (“Product”) that you have purchased is free from defects in materials and workmanship under normal use during the Limited Warranty Period. The Limited Warranty Period starts on the date of shipment from AKO and ends one year thereafter. You are entitled to product warranty service according to the terms and conditions of this document if a repair to your Product is required within the Limited Warranty Period. If End User notifies AKO during the warranty period of a defect in the Equipment, AKO will, at its discretion, repair or replace any defective component or unit. AKO is permitted to attempt repair via telephone support. If AKO determines that further repair or support is needed, the End User must obtain approval from AKO in writing before sending the Product to AKO. AKO, at its sole discretion, may elect to provide you with (a) a replacement unit of AKO’s choosing that is the same or equivalent to your Product in performance or (b) give you a refund of your purchase price instead of a replacement. AKO is not responsible for any damages once the product leaves AKO’s facility. This is your exclusive remedy for any defective Product.
If End User requests on-site service during the Warranty, there will be a per call service charge. The return of the repaired or replacement unit of Equipment to AKO does not extend the warranty period.
EXCLUSIONS
AKO DOES NOT WARRANT THAT THE OPERATION OF THIS PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE. AKO IS NOT RESPONSIBLE FOR DAMAGE THAT OCCURS AS A RESULT OF YOUR FAILURE TO FOLLOW THE INSTRUCTIONS INTENDED FOR YOUR AKO PRODUCT OR OTHER APPLICABLE STANDARDS OR CODES.
This Limited Warranty does not apply to the following (1) electrical work external to such Product; (2) installation, maintenance, or removal of alterations, attachments, or other devices not furnished by AKO.; (3) on site services (including without limitation: installation or removal and costs related to these expenses); (4) services which cannot be practicably performed due to alterations in or attachments to the equipment; or (5) services for accessories. AKO does not warrant calibrations after first use or six months after the calibration certificate, based on whichever event occurs first.
This Warranty does not extend to any Product for repair or replacement of defective Product that has been damaged or rendered defective (a) as a result of accident, misuse, abuse, contamination, improper or inadequate maintenance or calibration or other external causes; (b) by operation outside the usage parameters stated in the user documentation that shipped with the product; (c) by user software, interfacing, parts or supplies not supplied by AKO; (d) by improper site preparation or maintenance; (e) virus infection, malware, ransomware, failure to update operating system(s) and/or software application(s), communication line failure, delays in transmission, unauthorized access to data, and/or lost, deleted, or inaccessible data; (f) loss or damage in transit, vandalism, or burglary of the Product, acts of terrorism, accident, or disaster, or other external causes (including water, wind, lightning, and/or dust); or (g) by modification or service by anyone other than (i) AKO, (ii) AKO authorized service provider, or (iii) your own installation of end-user replaceable AKO or AKO approved parts if available for your Product.
The Limited Warranty does not apply to the extent the defect in the Product is due to the use of the Product in conjunction with equipment and products not manufactured by AKO, or to Products from which the serial number has been altered, defaced, or removed.
LIMITATIONS OF LIABILITY
If your Product failed to work or perform as warranted above, the maximum liability of AKO under this Warranty is expressly limited to the lesser of the price you have paid for the product or the cost of repair or replacement of any hardware components that malfunctioned in conditions of normal use.
This Warranty extends only to the original purchaser of the Product. It may not be assigned to any third party. AKO may require the End User to provide proof of purchase as a condition of receiving warranty service. End User’s dated sales or shipping receipt, showing the date of shipping or date of purchase, is the End User’s proof of purchase.
EXCEPT AS INDICATED ABOVE, IN NO EVENT SHALL AKO BE LIABLE TO END USER OR ANY THIRD PARTY CLAIMING THROUGH END USER FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS OR SAVINGS, LOSS OF EARNINGS, GOODWILL, COSTS OF COVER, IN EACH CASE RELATING TO THIS WARRANTY OR TO THE EQUIPMENT, EVEN IF SUCH DAMAGES WERE FORESEABLE AND EVEN IF THIS WARRANTY FAILS OF ITS ESSENTIAL PURPOSE.

RETURNS AND REPAIRS
End User is responsible for the return of the Equipment to AKO at End User’s expense. AKO will pay for ground shipping of the repaired or replacement unit to customer(s) site if End User’s shipping address is located in the continental United States & Canada. All duties and taxes are to be paid by the End User. AKO is not responsible for any damage while sending the product back to the End User.
AKO will attempt to repair all equipment within five (5) business days following their receipt at AKO.
CHOICE OF LAW
If any dispute arises out of this warranty agreement, the parties mutually consent to exclusive jurisdiction of any state or federal court having jurisdiction in Windsor, Connecticut. The laws of the State of Connecticut govern this warranty.
